my uncle introduced to me reddit and subsequently this subreddit, said i should post this here.
[video attachment: a ten second clip showcasing what at first glance looks like a porcelain bear. it had pink and white “fur” and big rosy cheeks. it was hard to tell it was mechanical at all, if it wasn’t for its idle movements alongside the quiet whirring that was almost drowned out by the sound of a fan in the background. a hand, entirely wrapped in oil (and possibly blood?) stained bandages reaches out to pokes its nose. a small honking noise plays as it moves its arms to cover its nose when the hand retracts.]

Theoretically, how hard is it to legally declare someone alive after death? As in, let’s say they went missing and were declared legally dead. But they returned very much alive. How does one go through the process of proving their life, legally?

In this case, theoretically, a presumption of death can be overturned, but it’s not guarenteed that anything they owned (that has been sold and whatnot) can be reclaimed. It’s rare for something like this to happen, as it’s most common with prisoners of war. As long as you have a way to prove that this person is, in fact, that person, it’s no more complicated than arranging a funeral.

It kind of depends, because if it were a 20 y.o. who is now 27, there wouldn’t be much of a difference. But if they were a child when they went missing, it’s really up to hoping they look the same. In the U.S., for a missing person to be presumed dead, 5 to 7 years will have to pass. Unless you lost this theoretical person in a state of emergency, that would expedite the process. As long as they still have their I.D., or any prominent features that would be hard to impersonate, it’s not too hard. But if they’re lacking in all of that, any living relatives of the deceased would be ideal to test for DNA.

as u/CheerfulVictory mentioned, proof of life isn’t too hard. as long as they aren’t like, famous, or an identity someone really wants for whatever reason. this is kind of why reclaiming past assets is tough, since no one wants to risk legally letting someone steal another’s identity alongside all of their shit. DNA is always an option, but if there are no living relatives, and fingerprints were never previously recorded, it really depends on whether or not you’re close enough to the rpev. deceased to have no reason to lie and allow a fraud take their identity.

Thank you for the advice! Unfortunately, living relatives are off the table. As for fingerprints, would a juvenile detention center keep them on record, even after all this time?

im sorry for your/his loss. juvie definitely puts those on record, and unless he went to court to get those records expunged, they will definitely still have them.

Sorry if this is a little vague, but it was supposed to be a prank. We never wanted to kill anyone. (read the accidental bit of the title). it involved something you shouldn’t put a kid’s head into. edit: it’s vague because if i give too many details, you can find it.

I’m taking a psychiatry class while pregnant. This is not a fun memory, but the only one I’ve talked to about it was my husband, who was a part of it. I think I just needed to hear unbiased opinions and questions i need to reflect on, honestly.

My friend, who was the instigator of the prank, took most of the fall. The rest of us got off with a slap on the wrist because we were “being forced to comply”, or something. The aftermath was just messy. It was his little brother.

now thats the kind of shit i would hear if i went to a therapist. i was 12. the kid just turned 7. i’d say i learned a lot, but moreso in reality i know what not to do with my kid once it finally pops out lol
